The Difference between Assault & Battery
Although assault and battery are commonly grouped together, they are actually two different crimes. Assault is, "...an unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another." You do not have to actually injure someone to be charged with assault, there only needs to be an attempt. On the other hand, battery is, "...any willful and unlawful use of force or violence upon the person of another." If a person is actually injured, then the battery charge would be applicable.
Penalties for being found guilty of assault include a fine of up to $1,000 and/or imprisonment in the county jail for up to 6 months. These penalties can be enhanced if the victim was a peace officer, emergency medical technician, firefighter, process server, doctor or nurse or animal control officers who are performing their duties. The fine for battery can be as high as $2,000 with 6 months in jail. Again, depending on who the victim was, you could spend upwards of 1 year in jail.
