After a DUI arrest is made and charges are filed, the defendant will be scheduled for a misdemeanor arraignment.
This is actually the defendant's first appearance in Court, and the following will occur at this time:
- You will be informed of the DUI charges which have been filed against you.
- You will be advised of your constitutional rights
- If you have not or cannot hire an attorney of your own, the Court will appoint an attorney to defend you.
- You will then enter a plea of guilty, not guilty, or no contest. Guilty - an admission that you have committed the crime. Not guilty - the statement that you did not commit the crime you are accused of. No contest (nolo contendere) - that you do not contest the charges against you. This has a similar effect as a guilty plea, but the subsequent conviction will not then be able to be used against you as proof of liability in a civil suit.
- You will then be released on your own recognizance, or the Court will set a bail amount and you will be taken into custody of the Sheriff until bail is made.
The advantage of working with a private attorney rather than one appointed by the state is this: your private attorney and his or her staff will be working directly for you. Often a state-appointed attorney may be overworked and inexperienced. He or she simply may not have the time for you.
